Medical Law- Negligence/malpractice

Almost every day we hear of rights being infringed at hospitals or clinics and some people have even lost their lives as a result of medical negligence or malpractice.
Most of the issues encountered are a disregard of basic principles of medicine, failure to document clinical findings and management. Generally, the first step of patient evaluation which is history and clinical examination is sketchy and cursory.
The other alarming issue is that specialists work across several hospitals and often rely on underqualified nursing staff to manage patients’ post-operative course.
In most instances, all goes well but when problems arise, there isn’t a defence simply because there is no written evidence to defend against a complaint.
